Not legal advice. This template is a general sample, not legal advice, and it doesn't create any legal protection by itself. Have a Utah attorney review it if you need certainty.

Quick summary: Utah law doesn't require a bill of sale for a private gun sale, but it's a smart record for both people. It shows who sold what gun to whom, when, and for how much. Fill out two copies, both sign, and each keep one in a safe place.

Why use a bill of sale for a gun?

A bill of sale doesn't make a sale legal or illegal. The law about who can buy still applies (see How to Sell a Gun Privately in Utah). But a signed record helps:

  • Sellers show the date the gun left their hands, if it's ever traced or misused later.
  • Buyers show they own the gun and paid for it.
  • Both have the serial number written down, in case of theft or a dispute.

If you use a dealer (FFL) for the transfer, the dealer's records (including ATF Form 4473) document it. A bill of sale is still handy for your own files. See FFL Transfers Explained.

What to include in a Utah gun bill of sale

  1. Date and place of the sale (city and county).
  2. Seller's full name and address.
  3. Buyer's full name and address.
  4. ID check. The type of ID shown (for example, Utah driver license) and that it showed Utah residency. We suggest not writing the full ID number; the last four digits are enough. No law requires a private seller to record an ID number, and a full ID number on a paper form is an identity-theft risk.
  5. Gun details: make (manufacturer), model, caliber or gauge, type (pistol, rifle, shotgun, revolver), and serial number.
  6. Price and how it was paid (cash, at an FFL, trade).
  7. "As is" statement. Most private sales are "as is." Say so plainly.
  8. Buyer statements (see the template). These don't replace the law, but they put the buyer's statements in writing.
  9. Signatures of both people. A witness or notary is optional.

How to fill it out, step by step

  1. Print two copies before you meet.
  2. Check ID at the meetup. Make sure the address shows Utah. If not, stop and use an FFL in the buyer's state.
  3. Compare the serial number on the gun to the form. Read it off the gun itself.
  4. Run the free stolen check (buyer). Utah's Gun Serial and CFP Search is free and anonymous. See How to Check if a Gun Is Stolen.
  5. Fill in the price and payment. Count cash before signing.
  6. Both sign both copies. Each person keeps one.

Keeping your bill of sale safe

A bill of sale has names, addresses and part of an ID number. Treat it like any personal document:

  • Keep paper copies in a locked drawer or safe.
  • If you take a photo, store it somewhere private, not in a shared album.
  • Don't post a filled-out bill of sale online.

GunTreasure doesn't collect or store your bill of sale.

What a bill of sale can't do

  • It can't make a sale to a prohibited person legal.
  • It can't make an out-of-state sale legal without an FFL (18 U.S.C. 922(a)(5)).
  • It doesn't register the gun. Utah has no state gun registry or registration requirement, and federal law bars ATF from creating a national one from dealer records (18 U.S.C. 926(a)).
